In a typical scenario, a gun is found in my client's car during a traffic stop or search of their person. It is discovered that my client does not have the required license to carry or transport the weapon, and police take him into custody.
I research the type of weapon and the permit required; for certain types of guns a license is mandatory for possession outside of the home, but is not mandatory for keeping in the house. I have been successful in getting charges reduced to a "Section H" [M.G.L. 140 § (h)] charge of providing false information on a permit application, which carries a fine or minimal jail time.
