Uncontested Divorce — Flat Rate
An uncontested divorce occurs when a husband and wife agree on all divorce-related issues (regarding property division, child custody, alimony, etc.) before they go to court. Because the court does not have to make judgments on these topics, an uncontested divorce is a relatively straightforward process.
At David M. Gabriel & Associates, we handle most uncontested divorces for a $1,500 flat fee. If the parties are in agreement, a divorce judgment may be granted in as little as five weeks. Divorce in Massachusetts becomes final 90 days after the entry of judgement.
Representing Military Spouses and Members of the United States Military Services
Many issues arise when a service member and spouse decide to divorce. The non-member spouse's eligibility post divorce for commissary, exchange and health care benefits and the non-member's ability to receive a percentage of the service member's military retired pay are generally of paramount concern. Under the Uniformed Services Former Spouse Protection Act (USFSPA) the non-member spouse may continue to receive such benefits post divorce in certain cases. Under Massachusetts law, the court may treat military retired pay as property, subject to division in divorce cases.
